Description

Prairie Financial Group® invites you to a complimentary luncheon webinar on the Trustee's Duty to Account and Disclose.

The open disclosure of information to beneficiaries is one of the fundamental duties of a trustee, and is also typically viewed as an indicia of a trustee acting in good faith. The trustee's duty to disclose at common law is rarely subject to controversy, but to whom the duty is owed is a source of regular uncertainty and ongoing litigation. There also are new developing rules on the ability of a trust settlor to override the common law duty and create a "silent trust." This session will explore a number of areas in-depth, including:

- The duty to disclose information and the duty to account
- Disclosure as a tool to manage risk
- To whom the duty applies
- Power of the settlor to alter the duty and statutory authorization to do so
- Operation of silent trusts and their danger

Speakers (via webinar):

Thomas W. Abendroth, Partner, Schiff Hardin LLP
Charles "Skip" D. Fox IV, Partner, McGuireWoods LLP

To reserve your seat, please RSVP by Tuesday, April 3.
